Terms of Service

By using Setform you agree to these terms. They are written in plain English; if a clause is unclear, email [email protected] and we will explain.

1. About Setform

Setform is a surf-forecasting site operated by Brian Wilson, an individual based in Switzerland. It is currently offered free of charge and is at present run as a non-commercial side project rather than a registered business. The operator is, however, building Setform with the intention of offering paid services in future, and reserves the right to introduce paid access for individuals, for businesses, or both. See section 9, "Pricing and paid access." Forecast data is sourced from Open-Meteo under the Creative Commons Attribution 4.0 licence and modified for presentation.

2. Using the service

You may use Setform for personal, non-commercial purposes. You agree not to:

• Scrape, crawl, or automate access at a scale beyond ordinary human use.
• Attempt to break, overload, or otherwise disrupt the service.
• Attempt to access another user's account or data, or any non-public part of the system.
• Impersonate any person or misrepresent your identity to the service.
• Use the service in any way that violates applicable law.

If you wish to redistribute or build on the underlying forecast data, please consult Open-Meteo's own terms and credit them per the CC BY 4.0 licence.

3. Your account

Creating an account is currently free and optional. If you create one:

• You are responsible for keeping your password secure and for activity that happens under your account.
• You agree to provide an email address you control, so that account-related messages (verification, password resets, important notices) reach you.
• One person, one account.
• You may delete your account at any time from your account page. Doing so immediately erases your account row and associated data.
• The operator may suspend or terminate accounts that violate these terms.

4. Forecasts are informational only

Setform is not affiliated with any rescue, lifeguard, weather, or maritime authority. Conditions on the ground are the only source of ground truth.

5. Intellectual property

Forecast data is provided by Open-Meteo under CC BY 4.0, modified for presentation. The Setform source code is published under the licence shown in the project repository. The Setform site design, copy, and branding are © Brian Wilson, all rights reserved.

6. No warranty

Setform is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, timeliness, completeness, availability, or non-infringement. The operator does not warrant that the service will be uninterrupted, error-free, or free of harmful components, or that any errors will be corrected.

7. Limitation of liability

To the maximum extent permitted by applicable law, the operator shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the service, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not the operator has been informed of the possibility of such damage.

This explicitly includes, without limitation, any personal injury, death, or property damage connected to your decision to enter the water or to take any other action informed by a forecast viewed on Setform.

If, despite the above, the operator is found liable to you for any reason, the operator's total liability shall not exceed CHF 50 (Swiss Francs) or the equivalent in your local currency.

7a. Rights that cannot be excluded

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited. Sections 6 and 7 apply only so far as the law allows, and are subject to this section.

This includes, without limitation: liability for death or personal injury caused by intent or by gross negligence, which cannot be excluded in advance under Article 100 of the Swiss Code of Obligations; and any liability arising under mandatory consumer-protection or product-liability rules of your country of residence. If you are a consumer in the European Economic Area, the United Kingdom, or Switzerland, your statutory rights are not affected by these terms.

If any part of these terms is found to be unenforceable, that part applies in the narrowest form needed to make it enforceable, or is severed if it cannot be, and the remaining terms continue in full effect.

8. Indemnification

You agree to defend, indemnify, and hold the operator harmless from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from your violation of these terms or your misuse of the service.

9. Pricing and paid access

Setform is free to use today. The operator is building Setform as the foundation of a future paid service and reserves the right to introduce paid access, paid features, subscription tiers, or paid business and commercial services for individual users, for businesses, or both, at any time.

If paid access is ever introduced:

• Features that are free today may remain free, move to a paid tier, or be replaced, at the operator's discretion. Nothing in these terms obliges the operator to keep any part of the service free.
• Prices, currencies, and billing terms will be shown clearly before you are asked to pay. You will never be charged without first agreeing to a specific price. Creating a free account today does not enrol you in any paid plan.
• The operator may, entirely at its discretion, offer existing or early users continued free access or preferential pricing as a thank-you, but makes no promise of perpetual free access, and no free access available today is guaranteed to remain free.
• Business and commercial use, for example in-store, venue, or event displays, may be offered under separate terms and pricing.

10. Changes to these terms

The operator may update these terms from time to time. The "Effective" date at the top of this page always reflects the current version.

If a change would meaningfully reduce your rights or increase your obligations, account holders will be notified by email at least 14 days before it takes effect. Other changes take effect when published, shown by an updated "Effective" date. These include corrections, clarifications, renumbering, changes that are in your favour, and changes required by law.

Continuing to use the service after a change takes effect means you accept the updated terms. If you do not accept a change, you may delete your account at any time from your account page.

11. Governing law and jurisdiction

These terms are governed by the laws of Switzerland, excluding its rules on conflict of laws. The competent Swiss courts shall have exclusive jurisdiction over any dispute arising from these terms or from your use of the service, subject to any mandatory consumer-protection rights of your country of residence.
