Terms of Service

By using Setform you agree to these terms. They are written in plain English; if a clause is unclear, email [email protected] and we will explain.

1. About Setform

Setform is a free, non-commercial surf-forecasting site operated by Brian Wilson, an individual based in Switzerland. It is a side project, not a registered business. Forecast data is sourced from Open-Meteo under the Creative Commons Attribution 4.0 licence and modified for presentation.

2. Using the service

You may use Setform for personal, non-commercial purposes. You agree not to:

  • Scrape, crawl, or automate access at a scale beyond ordinary human use.
  • Attempt to break, overload, or otherwise disrupt the service.
  • Attempt to access another user's account or data, or any non-public part of the system.
  • Impersonate any person or misrepresent your identity to the service.
  • Use the service in any way that violates applicable law.

If you wish to redistribute or build on the underlying forecast data, please consult Open-Meteo's own terms and credit them per the CC BY 4.0 licence.

3. Your account

Creating an account is free and optional. If you create one:

  • You are responsible for keeping your password secure and for activity that happens under your account.
  • You agree to provide an email address you control, so that account-related messages (verification, password resets, important notices) reach you.
  • One person, one account.
  • You may delete your account at any time from your account page. Doing so immediately erases your account row and associated data.
  • The operator may suspend or terminate accounts that violate these terms.

4. Forecasts are informational only

Surf conditions are inherently variable and can be dangerous. Setform is an informational tool, not a safety-of-life service.

Forecast data is modelled and may be wrong, late, or unavailable without notice. Do not rely on Setform alone to decide whether it is safe to enter the water. Always consult lifeguards, coast-guard advisories, local authorities, and your own judgment. Your decision to surf — and any consequences that follow — is yours alone.

Setform is not affiliated with any rescue, lifeguard, weather, or maritime authority. Conditions on the ground are the only source of ground truth.

5. Intellectual property

Forecast data is provided by Open-Meteo under CC BY 4.0, modified for presentation. The Setform source code is published under the licence shown in the project repository. The Setform site design, copy, and branding are © Brian Wilson, all rights reserved.

6. No warranty

Setform is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, timeliness, completeness, availability, or non-infringement. The operator does not warrant that the service will be uninterrupted, error-free, or free of harmful components, or that any errors will be corrected.

7. Limitation of liability

To the maximum extent permitted by applicable law, the operator shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the service — whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not the operator has been informed of the possibility of such damage.

This explicitly includes, without limitation, any personal injury, death, or property damage connected to your decision to enter the water or to take any other action informed by a forecast viewed on Setform.

If, despite the above, the operator is found liable to you for any reason, the operator's total liability shall not exceed CHF 50 (Swiss Francs) or the equivalent in your local currency.

8. Indemnification

You agree to defend, indemnify, and hold the operator harmless from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from your violation of these terms or your misuse of the service.

9. Changes to these terms

The operator may update these terms from time to time. Material changes will be reflected in the "Effective" date at the top of this page and, for account holders, notified by email. Continuing to use the service after a change takes effect means you accept the updated terms.

10. Governing law and jurisdiction

These terms are governed by the laws of Switzerland, excluding its rules on conflict of laws. The competent Swiss courts shall have exclusive jurisdiction over any dispute arising from these terms or from your use of the service, subject to any mandatory consumer-protection rights of your country of residence.
